Problem scanning 2023 passport: Could not tranceive APDU

I had no issues scanning other passport but there is this one issued in 2023 this year, I am getting the following error on nfc screen (tried re-positioning several time)

net.sf.scuba.smartcards.CardServiceException: Error occured. CAPDU = 027C228D205EA7454E9F46D3D47058391B69AB8512E132E6AFADSD61D3966850A095ED2A3D90 (SW = 0X3D90: Unknown

when I re-position and re-scan attempt number 3 or 4 I saw this message:
ADP ERROR ??
net.scf.scuba.smartcard.CardServiceException: Could not tranceive APDU

Is this related with JMRTD-to-new-chip format as its distinctly the 2023 issues passport having this issue?

update: when i scan 2022 issued passport just after above it scans fine
